Photofacts Photos terms

These are the terms between you and Photofacts BV for using Photofacts Photos. We've kept them as short and clear as we can. The most important thing first: your photos stay yours.
1. Who we are and what Photos is
Photofacts Photos ("Photos") is a service of Photofacts BV (Dutch Chamber of Commerce no. 64981096, Industrieweg Oost 21, 6662 NE Elst, the Netherlands), the publisher of Photofacts. You use Photos through the apps for iPhone and Android and at photofacts.com/photos. Your Photos account is your Photofacts account. Besides these terms, the general terms of use of Photofacts apply; where they conflict, these terms prevail.
2. Age
You must be at least 16 to use Photos. Posts with nudity are only shown to users aged 18 or over who choose to see them. We only use your date of birth for these limits; nobody else sees it.
3. Your account
- Provide accurate details. One account is for one person.
- You're responsible for what happens with your account. Keep your password secret.
- Your @name is unique. If an @name is misleading or infringes someone else's rights (such as a brand name), we may change it.
4. Your photos stay yours
- You keep all rights to what you post, including copyright.
- To make Photos work, you give Photofacts BV permission (a non-exclusive, royalty-free licence) to store, resize and show your posts in the apps, on photofacts.nl and photofacts.com, and in the previews that appear when someone shares a link to your post.
- This permission only applies while your post is online. We don't use your photos in advertising or other promotion and don't sell them to others. If we'd like to use a photo of yours elsewhere, for example in an article, we'll ask you first.
- If you delete a post or your account, the permission ends. We remove the files right away.
- By posting, you declare that you have the rights to do so, and that recognisable people in the picture agree where that's needed.
5. Guidelines and moderation
- You follow the community guidelines.
- Every post goes through an automatic check before it goes online; a moderator reviews uncertain cases and reports within 24 hours.
- We may hide or remove posts, comments and profiles that break the guidelines or the law, and block your account for repeated or serious violations. We always tell you why, and you can appeal (see section 10).
- If there are signs of child abuse or another serious crime, we involve the police.
6. Free and Pro
- Photos is free. With a free account you can post up to 5 posts per 24 hours.
- With Pro you post without limits and get a badge next to your name. Active members of Photofacts Academy have Pro for as long as their membership runs.
- If a paid Pro subscription becomes available, we'll add the price, the term and how to cancel to this section before you can sign up.
7. Availability
We do our best to keep Photos running smoothly, but we can't promise it will never be briefly unavailable. Photos isn't a backup service: we only keep a resized version of your photos (up to 4096 pixels), so keep your originals yourself. We may change or extend Photos, or, with reasonable notice, discontinue it.
8. Liability
Photofacts BV isn't liable for damage caused by using Photos, by Photos being unavailable or by posts being lost, except in case of intent or gross negligence on our part, or where the law says otherwise. You're responsible for what you post.
9. Leaving
You can delete your account at any time, in the app (Settings, Delete account) or on the website. Everything you did in Photos is then removed. We may end your account for serious or repeated violations of these terms or the guidelines.
10. Reports, appeals and contact
You can report any post, comment or profile in the app. You appeal a decision about your post in the app, on the post. For anything else, also if you don't have an account, and for authorities: info@photofacts.nl or the contact form. We reply in English or Dutch.
11. Changes
We may change these terms. For a substantial change we'll let you know in advance, by email or in the app. If you keep using Photos after that, the new version applies. The date at the top shows which version this is.
12. Law
These terms are governed by Dutch law. If we can't resolve a dispute together, the competent court in the Netherlands decides. As a consumer you can always also go to the court where you live.
